AN ACT 1
To enact R.S. 25:912(15) and 914, relative to certain cemeteries within the state of 2
Louisiana; to provide for the creation of a historic cemetery register within the 3
division of historic preservation, office of cultural development, Department of 4
Culture, Recreation and Tourism; to provide relative to the nomination, review, and 5
approval of any such cemetery for inclusion on the state register; to provide relative 6
to the adoption of rules and regulations by the division; and to provide for related 7
matters. 8
Be it enacted by the Legislature of Louisiana: 9
Section 1. R.S. 25:912(15) and 914 are hereby enacted to read as follows: 10
§912. Duties and responsibilities 11
The division shall have the following duties and responsibilities: 12

(15) Establishing and maintaining a register of historic cemeteries located 14
in Louisiana in accordance with the provisions of R.S. 25:914. 15

§914. Louisiana Register of Historic Cemeteries 17
A. The division shall be responsible for establishing and maintaining a 18
register of historic cemeteries located in Louisiana in accordance with the provisions 19
of this Section. The register shall be known as the Louisiana Register of Historic 20
Cemeteries. The register shall be established and maintained for the purpose of 21
recognizing cemeteries as being among the most valuable historic resources of the 22
state of Louisiana as cemeteries can reveal information about the historic events, 23
religion, lifestyles, and genealogy of a local community. 24

B. The division shall establish an application process by which a cemetery 1
may be nominated to the division for placement on the state register. A cemetery 2
may be nominated by any person, agency, organization, or political subdivision of 3
the state of Louisiana. The division shall make an application for nomination 4
available to any person who requests such application. 5
C. No cemetery shall be considered for placement on the state register unless 6
it is at least fifty years old, or contains the burial of a person of local, state, or 7
national importance by reason of civic, public or military service, cultural 8
achievement, or historical significance, or contains structures that are considered 9
architecturally significant. Any person, agency, organization, or political subdivision 10
nominating a cemetery to the division for inclusion on the state register shall submit 11
photographs, maps, and any historical data regarding the significance of any such 12
cemetery. The division shall promulgate such rules and regulations for the 13
nomination, review, and approval of any application submitted pursuant to this 14
Section in accordance with the provisions of R.S. 25:913(B). 15
D. The division may cooperate with all departments, commissions, boards, 16
agencies, officers, and institutions of the state and all political subdivisions thereof 17
in carrying out the purposes of this Section. 18
Section 2. This Act shall become effective upon signature by the governor or, if not 19
signed by the governor, upon expiration of the time for bills to become law without signature 20
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 21
vetoed by the governor and subsequently approved by the legislature, this Act shall become 22
effective on the day following such approval. 23
